San Diego, September 26, 2014 – A case was recently decided in California Courts that has implications throughout the Off-Site Modular Construction industry in California. On August 27, 2014, the California Court of Appeal issued a decision in the long-anticipated Russ-Will case, Sheet Metal Workers’ International Association, Local 104 v. Duncan; Russ Will Mechanical, Inc., Court of Appeal of the State of California, First Appellate District, Division Three, No. A131489 (August 27, 2014). The court held that the California prevailing wage law does not apply to employees who fabricate materials for a public works project at a permanent, offsite manufacturing facility that is not exclusively dedicated to the project. It is a published decision, which means it is binding upon the California trial courts, the California Department of Industrial Relations (DIR), and the Division of Labor Standards Enforcement.
The Russ-Will decision is an extraordinarily important decision for any Project Owner, Contractor, or Supplier involved with public works construction in California. The decision brings to rest significant confusion and debate over whether the off-site fabrication of items to be used on a public works construction site is subject to California’s prevailing wage and apprenticeship requirements.
USModular, Inc. (www.usmodularinc.com) President Todd Kesseler commented that “this ruling will have a positive effect on Affordable Housing construction projects like the 87-unit Valencia Grove project in Redlands, California that USModular is building. The Developer will save time with Off-Site Modular Construction and will continue to save money as they will not be subject to prevailing wages for the 80 plus percent of the project built Off-Site in our manufacturing facility”.
More developers and property owners are looking at Off-Site Modular Construction as a cost effective style to build their next project as they can typically save up to 50% in permitting and construction time. Time savings that translates into lowering carrying costs and a quicker cash flow/ return on investment.
